Terms of Service
Last Updated: October 2026 · Governing all private charter arrangements in India
1. Role as an Air Charter Broker
Mandatory Regulatory Notice: KC Air (KC Air Charter Brokerage) acts solely as an independent air charter broker and does not own, maintain, or operate aircraft. We are not a direct or indirect air carrier. All charter flights arranged by KC Air are operated exclusively by third-party air carriers possessing a valid Non-Scheduled Operator Permit (NSOP) issued by the Directorate General of Civil Aviation (DGCA), Government of India.
The operating NSOP carrier maintains exclusive operational control of the aircraft at all times, including crew selection, flight planning, fuel loading, ATC routing, weather assessments, and the final decision to commence or terminate any flight in the interest of safety.
2. Quotations & Booking Confirmation
- Quote Validity: All charter quotations provided by KC Air are subject to aircraft availability, crew duty hours, and DGCA runway slot clearances at the time of formal confirmation.
- Binding Confirmation: A booking is confirmed only upon execution of the official KC Air Charter Agreement and receipt of the agreed deposit or full payment as stipulated in the charter invoice.
- Taxes & Statutory Levies: In accordance with Indian tax laws, Goods and Services Tax (GST) is levied at the applicable statutory rate (currently 18% on air charter services) in addition to airport passenger service fees (PSF) and user development fees (UDF) where applicable.
3. Passenger Documentation & Baggage
The Charterer agrees to provide complete and accurate passenger manifests (including full legal names as per government IDs, nationality, and contact details) no later than 24 hours prior to departure, or immediately upon booking for urgent flights.
All passengers must carry valid government-issued photo identification (Aadhaar Card, Passport, Voter ID, or Driving License; Passport with valid Indian Visa for foreign nationals) for CISF and airport entry screening.
Baggage must strictly comply with the manufacturer weight and volumetric limits of the assigned aircraft category. Hazardous goods (flammables, explosives, lithium batteries exceeding permitted capacities) are strictly prohibited in accordance with DGCA Safe Transport of Dangerous Goods regulations.
4. Force Majeure, ATC & Weather Delays
Neither KC Air nor the operating NSOP carrier shall be deemed liable for delays, rerouting, or flight cancellations caused by events beyond reasonable control (“Force Majeure”), including but not limited to:
- Inclement weather conditions (fog, low visibility, cyclones, heavy monsoon squalls) below DGCA operating minima.
- Air Traffic Control (ATC) ground hold orders, VIP/VVIP movement airspace restrictions, or airport runway closures.
- Unforeseen mechanical malfunctions (Aircraft on Ground - AOG) discovered during pre-flight technical inspections.
In the event of an AOG snag, KC Air will make every commercial effort to mobilize a substitute aircraft from its broker network at prevailing operator rates, subject to client approval.
5. Limitation of Liability
Passenger injury, death, or baggage loss liability is governed exclusively by the operating NSOP carrier's conditions of carriage and the Carriage by Air Act, 1972, as amended from time to time. As a broker, KC Air shall have no liability arising out of the flight operations, aircraft maintenance, or actions of the operating flight crew.
6. Governing Law & Jurisdiction
These Terms of Service and any charter agreements brokered by KC Air shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in New Delhi, India.
